हेट स्पीच पर चंद्रधारी सिंह का रिकॉर्ड ख़राब, प्रदेश का मुख्य न्यायाधीश बनने से नफरत फैलाने वालों का मनोबल बढ़ेगा:शाहनवाज़ आलम
Lucknow, 1 December 2024. While being a judge in the Delhi High Court, Chandradhari Singh had refused to consider Anurag Thakur guilty in a case of inciting violence like 'goli maaro saalon ko'. His argument was that he had raised this slogan while smiling, so it would not be considered a threat and hate speech. Appointing Chandradhari Singh, who has given such controversial decisions, as the Chief Justice of Allahabad High Court will send a wrong message to the public. Such a situation is developing where the peace and order of the state seems to be under threat from the judiciary itself. These things were said by All India Congress Committee Secretary and Bihar Co-incharge Shahnawaz Alam in the 171st episode of the weekly Speak Up program. Shahnawaz Alam said that while being a judge of the Delhi High Court in the Anurag Thakur case, he had said that "speeches given during elections are different. If this speech had been given at any other time, it would have been to provoke". Shahnawaz Alam said that the conclusion drawn from his explanation is that if anyone speaks hateful and provocative language during elections, the judge will not take any action against him. Shahnawaz Alam said that Uttar Pradesh has become the center of hate speech, which is being led by Chief Minister Yogi Adityanath himself. That is why the guidelines issued by the Supreme Court on hate speech are also not being followed in the state. In such a situation, after the arrival of the Chief Justice who does not consider hate speech a crime, the morale of those spreading hatred in the state will increase. Which will prove bad for the society and the state. Shahnawaz Alam said that at present there are many such judges in the district and high courts of Uttar Pradesh whose decisions and comments in communal language have already been ordered to be removed by the High Court and the Supreme Court itself. In such a situation, there will be a danger of the morale of such judges increasing during the tenure of Allahabad High Court Chief Justice Chandradhari Singh. All these situations are not good signs for peace and order in the state.

लखनऊ, 1 दिसंबर 2024. चंद्रधारी सिंह ने दिल्ली हाईकोर्ट में जज रहते हुए अनुराग ठाकुर को ‘गोली मारो सालों को’ जैसे हिंसा उकसाने वाले मुकदमे में अपराधी मानने से इनकार कर दिया था। उनका तर्क था कि यह नारा उन्होंने मुस्कुराते हुए लगाया था इसलिए इसे धमकी और हेट स्पीच नहीं माना जाएगा। ऐसे विवादित फैसले देने वाले चंद्रधारी सिंह को इलाहाबाद हाईकोर्ट का मुख्य न्यायाधीश नियुक्त किए जाने से जनता में गलत संदेश जायेगा। ऐसी स्थिति बनती जा रही है जहाँ प्रदेश की शांति व्यवस्था को न्यायपालिका से ही खतरा उत्पन्न होता दिख रहा है।ये बातें अखिल भारतीय कांग्रेस कमेटी के सचिव और बिहार सह प्रभारी शाहनवाज़ आलम ने साप्ताहिक स्पीक अप कार्यक्रम की 171 कड़ी में कहीं।शाहनवाज़ आलम ने कहा कि अनुराग ठाकुर मामले में दिल्ली हाईकोर्ट के जज रहते हुए उन्होंने कहा था कि “चुनाव के दौरान दिए गए भाषण अलग होते हैं. अगर यही भाषण किसी और वक्त दिया होता तो ये भड़काने के लिए होता”.शाहनवाज़ आलम ने कहा कि उनकी इस व्याख्या से यही निष्कर्ष निकलता है कि चुनाव के समय कोई भी नफरत और उकसाने वाली भाषा बोलेगा तो न्यायाधीश महोदय उसपर कोई कार्यवाई नहीं करेंगे।शाहनवाज़ आलम ने कहा कि उत्तर प्रदेश हेट स्पीच का केंद्र बना हुआ है जिसकी अगुवाई ख़ुद मुख्यमंत्री योगी आदित्यनाथ कर रहे हैं। इसीलिए सुप्रीम कोर्ट द्वारा हेट स्पीच पर जारी गाइडलाइन का भी पालन प्रदेश में नहीं हो रहा है। ऐसे में हेट स्पीच को अपराध न मानने वाले मुख्य न्यायाधीश के आने के बाद प्रदेश में नफरत फैलाने वालों का मनोबल बढ़ जाएगा। जो समाज और प्रदेश के लिए बुरा साबित होगा।शाहनवाज़ आलम ने कहा कि इस समय उत्तर प्रदेश के जिला और हाई कोर्ट में ऐसे कई जज हैं जिनकी सांप्रदायिक भाषा वाले फैसलों और टिप्पणीयों को खुद हाई कोर्ट और सुप्रीम कोर्ट फैसलों से निकालने का निर्देश दे चुका है। ऐसे में इलाहाबाद हाईकोर्ट के मुख्य न्यायाधीश चंद्रधारी सिंह के कार्यकाल में ऐसे जजों का मनोबल भी बढ़ने का खतरा रहेगा। यह सब स्थितियां प्रदेश में शांति व्यवस्था के लिए अच्छे संकेत नहीं हैं ।
