दुष्कर्म के दोषी बब्बू विश्वकर्मा को 10 वर्ष की कैद, 65 हजार रूपये अर्थदंड, न देने पर तीन माह की अतिरिक्त कैद भुगतनी होगी

According to the prosecution, the victim's father, a resident of a village in the Robertsganj police station area, informed in the Tahrir on 16th December 2017 that on 12th December 2017 at 3:00 p.m. 16-year-old minor daughter Babbu Vishwakarma aka resident of Siltham village of Rampur Barkonia police station area. Lal Babu seduced son Ramcharan Bah and took him away somewhere. On this Tahrir, the police registered an FIR on 16 December 2017 and started investigating the case. After finding sufficient evidence, the judge had filed a charge sheet in the court under rape and PASSO Act. During the hearing of the case, the court heard the arguments of the advocates of both the parties, perused the statements and letters of 8 witnesses and found the convict Babbu Vishwakarma guilty. Sentenced to 10 years imprisonment and 65 thousand rupees fine. Failure to pay fine will result in additional imprisonment of three months. At the same time, the victim will get 50,000 rupees from the monetary penalty. Public prosecutors Dinesh Prasad Agrahari, Satya Prakash Tripathi and Neeraj Kumar Singh argued for the prosecution.

सोनभद्र/उत्तर प्रदेश। सात वर्ष पूर्व 16 वर्षीय नाबालिग लड़की के साथ हुए दुष्कर्म के मामले में अपर सत्र न्यायाधीश / विशेष न्यायाधीश पाक्सो एक्ट सोनभद्र अमित वीर सिंह की अदालत ने शुक्रवार को सुनवाई करते हुए दोषसिद्ध पाकर दोषी बब्बू विश्वकर्मा उर्फ लालबाबू को 10 वर्ष की कैद एवं 65 हजार रूपये अर्थदंड की सजा सुनाई। अर्थदंड न देने पर तीन माह की अतिरिक्त कैद भुगतनी होगी। वहीं अर्थदंड की धनराशि में से 50 हजार रूपये पीड़िता को मिलेगी।अभियोजन पक्ष के मुताबिक रॉबर्ट्सगंज थाना क्षेत्र के एक गांव निवासी पीड़िता के पिता ने 16 दिसंबर 2017 को रॉबर्ट्सगंज थाने में दी तहरीर में अवगत कराया था कि 12 दिसंबर 2017 को शाम 3:00 बजे उसकी 16 वर्षीय नाबालिग बेटी को रामपुर बरकोनिया थाना क्षेत्र के सिल्थम गांव निवासी बब्बू विश्वकर्मा उर्फ लालबाबू पुत्र रामचरन बहला फुसलाकर कहीं भगा ले गया। इस तहरीर पर पुलिस ने 16 दिसंबर 2017 को एफआईआर दर्ज कर मामले की विवेचना शुरू कर दिया। विवेचक ने पर्याप्त सबूत मिलने पर कोर्ट में दुष्कर्म और पाक्सो एक्ट में चार्जशीट दाखिल किया था।मामले की सुनवाई के दौरान अदालत ने दोनों पक्षों के अधिवक्ताओं के तर्कों को सुनने, 8 गवाहों के बयान एवं पत्रावली का अवलोकन करने पर दोषसिद्ध पाकर दोषी बब्बू विश्वकर्मा को 10 वर्ष का कारावास एवं 65 हजार रूपये अर्थदंड की सजा सुनाई। अर्थदंड न देने पर तीन माह की अतिरिक्त कैद भुगतनी होगी। वहीं अर्थदंड की धनराशि में से 50 हजार रुपये पीड़िता को मिलेगा। अभियोजन पक्ष की तरफ से सरकारी वकील दिनेश प्रसाद अग्रहरि, सत्य प्रकाश त्रिपाठी एवं नीरज कुमार सिंह ने बहस की।
